1. Agreement to Terms

By accessing and using this platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Use License

Xperio3D grants you a limited, revocable, non-exclusive license to access and use the platform to build, publish, and manage immersive virtual-tour experiences for your business and your clients. This is a commercial SaaS license. Under this license you may not:

• Modify, copy, or redistribute the platform source, UI, or algorithms
• Reverse engineer, decompile, or attempt to extract the underlying software
• Remove proprietary or copyright notices from the platform
• Use the platform to replicate or replace Matterport Showcase, Workshop, hosting, or capture technology — Xperio3D is an Experience Layer over Matterport
• Obscure, remove, or modify Matterport's branding without written authorization from Matterport
• Access another tenant's data or bypass platform security

Commercial use of the Matterport SDK may require written Matterport authorization. You are responsible for your own Matterport licensing and for ensuring your use of Matterport content complies with Matterport's terms.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

4. Content

Our platform allows you to upload, store, and display content including but not limited to virtual tours, images, videos, and text. You retain all rights to the content you upload. By uploading content, you grant us a license to use, store, and display your content as necessary to provide our services.

5. Prohibited Uses

You may not use our platform:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations
• To infringe upon or violate our intellectual property rights
• To harass, abuse, insult, harm, defame, or discriminate
• To submit false or misleading information

6. Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

7. Limitation of Liability

In no event shall our company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

8. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions.
